1. Purpose – Scope These General Terms and Conditions of Sale ("GTC") govern all sales made via the www.mamedica.ma website and/or any online store operated by MAMEDICA SARL AU (notably via Shopify), to individual customers ("B2C") and professionals ("B2B"), in Morocco and internationally. Any order implies full and complete acceptance of the GTC. In the event of special conditions (quotation, call for tenders, contract), these shall prevail over the GTC only if accepted in writing by MAMEDICA.
2. Definitions "Client": any person placing an order. "Products": medical, paramedical products, consumables, orthopedics, technical aids, accessories. "Site": the website and its sub-domains/pages. "Carrier": delivery service provider.
3. Pre-contractual information – Products – Regulatory compliance The Products offered comply with applicable regulations (Moroccan standards, sanitary requirements). Visuals, descriptions, and technical sheets are provided for informational purposes only. The Client must verify the compatibility and suitability of the Product for their use.
4. Availability – Quantities – Substitution Products are offered within the limits of available stock. In case of unavailability, MAMEDICA will offer a deferral, an equivalent product, or a refund. Quantity limitations may apply.
5. Prices – Obvious errors – Taxes and customs Prices are indicated in MAD or international currencies, including VAT where applicable, excluding delivery costs. In case of an obvious price error, MAMEDICA may cancel or correct the order. International taxes and import duties are the responsibility of the Client.
6. Account creation – Security – Accuracy The Client is responsible for the confidentiality of their identifiers. MAMEDICA may suspend an account in case of fraud.
7. Order – Shopify Process – Proof The order is firm after confirmation and payment validation. Computerized records constitute proof of transaction.
8. Payment – Anti-fraud measures Payment by card, bank transfer, cash on delivery (under conditions). MAMEDICA may request supporting documents.
9. Electronic communications The Client accepts electronic communication (invoices, confirmations).
10. Delivery – Deadlines – Transfer of risks Indicative deadlines. Risks are transferred upon handover to the carrier. The Client must make reservations in case of damage.
11. Orthopedic products – Essential clause Orthopedic products and personal medical devices are neither returned nor exchanged except in case of proven defect.
12. Right of withdrawal (B2C) 14-day period for eligible products. Unsealed or personalized products are excluded. Professionals do not benefit from the right of withdrawal.
13. Return procedure – RMA Any return requires prior agreement. Refund occurs after inspection.
14. Legal guarantees – After-sales service Applicable legal guarantees. The warranty excludes misuse.
15. Liability – Limitation Liability limited to the amount of the product. Exclusion of indirect damages.
16. Services – Customer reviews Content moderated by MAMEDICA.
17. Intellectual property Any reproduction or extraction is prohibited.
18. Personal data – Cookies Processing in accordance with Moroccan law 09-08 and GDPR if applicable.
19. Export controls Compliance with import/export laws.
20. Force majeure Suspension of obligations in case of force majeure.
21. Modification of the GTC GTC applicable on the date of the order.
22. Nullity – Waiver The nullity of a clause does not affect the others.
23. Minors Orders under parental responsibility.
24. Language The French version prevails.
25. Applicable law – Jurisdiction Moroccan law. Competent courts of Rabat.
